Two Weeks Notice Letter

Two weeks notice is a US convention rather than a legal requirement in most states, where employment is at-will on both sides. It persists because it protects the reference, and the reference outlasts the job.

The letter itself is short. What matters more is counting the fortnight correctly and knowing what your employer may do with it.

Give notice on a Monday or Tuesday if you can choose. It leaves a full working week for the handover conversation before the countdown starts eating into it, and it avoids a resignation landing in a Friday inbox where it sits unanswered over a weekend.

What two weeks does and does not obligate

Almost all US employment is at-will, which means neither side owes the other notice as a matter of law. Two weeks is a professional norm, not a legal requirement, and framing it accurately matters because the norm cuts both ways: your employer is equally free to end the notice period the day you hand it in.

Where notice does become binding is in a written agreement — an employment contract with a notice clause, a signing bonus with a clawback tied to length of service, a relocation package repayable within a period, or a commission plan that pays only to employees on the books at payout. Read those before you set a date.

Some employers also condition the payout of accrued vacation on giving proper notice, where state law permits. That is the single most common way a resignation costs money, and it is entirely avoidable by reading the handbook first.

Counting the two weeks

Ambiguity here causes real disputes about final pay and benefits, and it is avoidable in one sentence.

State a final working day as an actual date. "Two weeks from today" invites a disagreement about whether the clock started on the conversation or the letter, and about whether the last day is a working day or a calendar one.

Two weeks conventionally means ten working days, not fourteen calendar days. Say the date and the ambiguity disappears.

Over the next two weeks I will close out my open tickets, document the escalation process I have been maintaining, and help however is most useful with the transition.

If you are asked to leave immediately

This surprises people and is entirely normal in some industries. Employers in sales, finance and anywhere with access to sensitive systems frequently end employment the day notice is given, for security reasons rather than as a judgement on you.

Whether you are paid for the notice period then depends on state law, your contract and company policy. Some employers pay it out; at-will employment in many states does not require them to. It is worth knowing your company's practice before you give notice, particularly if the timing of your final pay matters.

Being walked out is rarely personal. Where it is standard practice it applies to everyone, including good leavers.

Using the two weeks well

The fortnight is the last impression you leave, and it is the one people remember when a reference request arrives two years later. Coasting through it undoes a good tenure surprisingly effectively.

  • Write the handover document nobody asked for. It is the single most appreciated thing a leaver does.
  • Finish what can be finished, and be honest about what cannot rather than leaving it looking complete.
  • Return equipment and access properly, and confirm in writing what you returned.
  • Ask for the reference now, while people remember your work and still have your email in their inbox.
  • Keep personal contact details for the colleagues worth staying in touch with — company email disappears the moment you leave.

Health insurance and the gap between jobs

Employer coverage usually ends on your last day or at the end of that month, and the new employer’s plan often starts after a waiting period. The gap between the two is the thing people discover after they have already resigned.

COBRA lets you continue the old plan for a period, but you pay the full premium including the share the employer was covering, which is typically far more than the payroll deduction you are used to. Marketplace coverage is worth pricing against it, since losing job-based coverage opens a special enrolment window.

Confirm both dates before you set your final day — when your current coverage ends, and when the new plan begins.
